WEBSITE USER AGREEMENT
This website is owned and operated by LANKA CLASSY TOURS (PRIVATE) LIMITED, a company duly incorporated under the company laws of Sri Lanka, having its registered office at No. 41/1/2, Kelanisiri Mawatha Kelaniya, in the Democratic Socialist Republic of Sri Lanka (hereinafter, as and when the context so requires, called and referred to as “Lanka Classy Tours”).
By accessing and using this website, you agree to be bound by the terms and conditions of use, set out here in below. The attached terms of online reservations (hotel bookings, transport, vehicle hire, transfers & excursions) will apply when you make your reservations online and shall form part and parcel of this agreement. The principals of data protection of LANKA CLASSY TOURS are also annexed here to for your reference.
TERMS AND CONDITIONS OF USE
ACCEPTABLE USE
You (customer / agent) may use this website in accordance with these terms and conditions for lawful and proper purposes complying with all applicable laws, regulations and codes of practice in Sri Lanka or other jurisdictions from which you are accessing the website.
In particular, you (customer / agent) agree you (customer / agent) shall not post, transmit or disseminate any information via this website which is or may be harmful, obscene or otherwise illegal.
You (customer / agent) also agree not to:
• Use this website in a manner which causes or may cause an infringement of the rights of another.
• Use any software, routine, procedure or device to interfere or attempt to interfere with the operation or functionality of this website including but not limited to making available corrupt data, viruses via whatever means or interfere with its availability to others.
• Deface, alter or interfere with the look and feel of this website or underlying software code.
• Take any action that imposes an unreasonable or disproportionately large load on the website or related infrastructure.
• Obtain or attempt to obtain unauthorized access by whatsoever means to any of our networks.
• Where Lanka Classy Tours believe in its absolute discretion that you (customer / agent) are in breach of any of these terms and conditions, without prejudice to any of our rights at law or otherwise, we reserve the right to deny you (customer / agent) access to this website.
COPYRIGHT AND RESTRICTIONS ON USE
All trademarks, service marks, copyright, database rights, and other intellectual property rights in materials on this website, as well as the organization and layout of this website together with the underlying software, belong to Lanka Classy Tours or its licensors.
The trademark, service mark and logos of Lanka Classy Tours and its licensors must not be used, modified or adapted in any way without the prior written authorization of Lanka Classy Tours.
The material on this website and the underlying software codes may not be copied, modified, altered, published, broadcast, distributed, linked to another website, sold or transferred whole or in part without an express written permission of Lanka Classy Tours. MODIFICATION OF TERMS
Lanka Classy Tours may make improvements and / or changes in the products, services and prices described in this website at any time without prior notice. Changes are periodically made to the website. Lanka Classy Tours may amend these terms by posting the amended terms on this website. Continued use of this website following such changes shall constitute your (customer / agent) acceptance of such changes.
AGE AND RESPONSIBILITY
You (customer / agent) represent that you (customer / agent) are of sufficient legal age to use this website; additionally, you (customer / agent) possess the legal right and ability to enter into this agreement and use this site in accordance with all of the applicable terms and conditions and create binding legal obligations for any liability you may incur as a result of the use of this website under your (customer / agent) name or account including, without limitation, all use of your (customer / agent) account by others including minors living with you (customer / agent).
PAYMENT POLICY
All services provided by Lanka Classy Tours (Pvt) Ltd are subject to the following terms and conditions “Services” refers to any one or more of the following; (a) Transport (b) Accommodation (c) Other tourist services.
Your booking.
Booking details must be completed personally by the traveler or by one person on behalf of a group who is deemed authorized by individual members (the “Client”) of the Group to contract on their behalf. Lanka Classy Tours (Pvt) Ltd will confirm the arrangements requested by the Client through web bookings as soon as reasonably possible upon receipt of the Booking details. Please note that for legal purpose, the contract comes into existence when a confirmation invoice has been issued by Lanka Classy Tours (Pvt) Ltd for service rendered by Lanka Classy Tours (Pvt) Ltd or on behalf of the relevant suppliers). Despite its best efforts, as services are obtained from third party suppliers, it may not be possible to confirm certain arrangements at once (e.g. when a hotel is only available on request). Where so specified the legal contract for the services concerned will be formed once Lanka Classy Tours (Pvt.) Ltd have specifically confirmed those services have been booked even if a previous interim confirmation has been issued.
The Client is responsible for checking the details of the confirmation invoice and should give immediate notice of any corrections thereto.
Your Contract.
This contract and all services provided by Lanka Classy Tours (Pvt) Ltd are exclusively governed by Sri Lankan law. The Client acknowledges that although the Contract is with Lanka Classy Tours (Pvt) Ltd, unless otherwise specified, all services are provided by third party service provider (eg hotels, bus operations, tours) and that whilst every effort has been made by Lanka Classy Tours (Pvt) Ltd to ensure that such services are safe, it is unable to accept responsibility for third party services out of its control. Lanka Classy Tours (Pvt) Ltd contracts as named agent only.
The Client specifically acknowledges that all arrangements made by Lanka Classy Tours (Pvt) Ltd for hotel accommodation, sightseeing tours and services, entertainment, transportation by air, railroad, motor bus, automobile, or boat, Lanka Classy Tours (Pvt) Ltd acts only in the capacity of an agent for the domestic airlines, hotels, and other suppliers for the Services described in the tour arrangements. In particular the Client acknowledges that because Lanka Classy Tours (Pvt) Ltd maintains no management control over the personnel, equipment, or operations of these Services suppliers, Lanka Classy Tours (Pvt) Ltd cannot assume responsibility for and be held liable for any personal injury, property damage or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason of (1) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of any of these suppliers, (3) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise, of Lanka Classy Tours (Pvt) Ltd.
The relevant suppliers’ terms and conditions will be available on the relevant voucher or can be obtained from the supplier.
Payment
Except where expressly specified by Lanka Classy Tours (Pvt) Ltd in writing, payment in full for all Services will be processed upon confirmation of arrangements or make the 50% of the full payment and settle the balance 50% before 21days of the arrival. In any event, notwithstanding anything to the contrary contained herein or in any other booking document Lanka Classy Tours (Pvt) Ltd is under no obligation to provide any Services until payment in full has been received therefor as specified in the payment confirmation page or as instructed in the confirmation email prior commencement of the tour. Lanka Classy Tours (Pvt) Ltd reserves the right to cancel the tour, and/or apply cancellation charges if payment is not made within the said period.
The cost of the Tour
The cost of Services may increase after confirmation if there have been increases in the costs at supplier level.
However, every effort shall be made by Lanka Classy Tours (Pvt) Ltd to limit price increases only to increase transportation costs (e.g. fuel, scheduled airfares and any other domestic airline surcharge which are part of the contract between domestic airlines (and their agents) and the tour operator or organizer) or in dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports or airports or because of adverse exchange rate variations after confirmation of the booking.
All increases in prices are payable by the dates stated in Clause 3 above or by the dates specified on the notice of increase, whichever is the later.
Amendments to the Itinerary by the Passenger
After confirmation, if the Client wishes to change the dates or nature of Services, an application to do so may be made on the Lanka Classy Tours (Pvt) Ltd website and Lanka Classy Tours (Pvt) Ltd shall endeavour to accommodate such changes at the least cost to the Client. The Client shall be responsible for all extra costs of such change. No credits or refunds for unused services shall be given if the Client fails to avail him/herself of the confirmed tour arrangements.
Complaints
If the Client has a complaint regarding hotel services the relevant supplier (e.g. the hotelier) should be informed immediately or as soon as possible (in any event no later than 24 hours) of the occurrence of the event giving rise to the complaint. If the supplier cannot resolve the complaint Lanka Classy Tours (Pvt) Ltd must be informed in writing within forty eight (48) hours with the original booking reference and all relevant information.
The Client acknowledges that problems can only be resolved if Lanka Classy Tours (Pvt) Ltd and service providers are made aware immediately as and when they occur. Lanka Classy Tours (Pvt) Ltd regrets that it cannot accept liability in relation to any complaint or claim which is not notified in accordance with this clause.
Any disputes arising between Lanka Classy Tours (Pvt) Ltd and the passenger in respect of any complaints remaining unresolved for more than thirty (30) days shall be referred to arbitration by a single arbitrator in accordance with the ICC Rules for Arbitration. The Language of the Arbitration shall be English and the place of Arbitration shall be Colombo, Sri Lanka.
The Client is responsible for consequences of illness and/or accidents and must pay possible expenses to doctors, hospitals, ambulances and special transports. It is his/her responsibility to have adequate medical insurance for such eventualities. Lanka Classy Tours (Pvt) Ltd also recommends that Clients obtain travel insurance with full cancellation cover.
Clients shall be responsible for ensuring that all visa, immigration and health requirements are fulfilled.
Clients hereby expressly acknowledge that all facilities, services made available and/or recommended by Lanka Classy Tours (Pvt) Ltd and utilised by the Client shall be at the Client’s risk and that Lanka Classy Tours (Pvt) Ltd shall not be responsible for any damage or injury to the Client in this regard unless caused by the negligence of Lanka Classy Tours (Pvt) Ltd
The Clients take responsibility for their own behaviour and will reimburse Lanka Classy Tours (Pvt) Ltd or its suppliers any damage caused by negligent or reckless behaviour by the Client or due to circumstances within the Clients control.
Support Companies Worldwide
Lanka Classy Tours (Pvt) Ltd is supported by certain affiliated companies who provide certain support services to Lanka Classy Tours (Pvt) Ltd including in some instances, limited customer care support (“Support Companies”). These Support Companies do not provide an online reservations service and they do not own, control, host, manage or maintain the Lanka Classy Tours (Pvt) Ltd website (or any other website). Lanka Classy Tours (Pvt) Ltd is domiciled only at its registered office in Sri Lanka and not at the offices of any Support Company around the world. The Support Companies are not authorised to act as Lanka Classy Tours (Pvt) Ltd process or service agents, and customers will also not be able to make a reservation in or through any of these offices.
Methods Of Payment:
Payments for deposits and final amounts for Travel Arrangements can be made through either:
Bank Transfer:
Any charges arising outside Sri Lanka should be borne by the remitter.
Credit Card (Visa and MasterCard):
A secure internet payment gateway facility is available.
A handling fee of 3.1% is charged additionally on top of the agreed invoice value.
Both credit and debit cards can be used for payments.
If paying by credit or debit card through the secure internet online payment gateway:
Payments are processed entirely on the Secure Payment Sites operated by Commercial Bank of Ceylon for Master and Visa card payments.
Your card details are neither received nor stored by Lanka Classy Tours in any form.
Your credit card information will be securely transmitted to Commercial Bank of Ceylon for transaction authorization.
Payments can be made US$
The SSL security internet protocol, known as Secure Socket Layer, ensures end-to-end encryption, providing data confidentiality and integrity services for application layer traffic between your web browser and the secured Commercial Bank of Ceylon payment gateway servers.
If payment deadlines are not met, we reserve the right to cancel your tentative booking and will inform you accordingly.
Price Policy:
We offer customized packages of land and/or air services to our clients, utilizing various suppliers. The pricing of Your Travel Arrangements is subject to the possibility of changes and surcharges beyond our control. These changes may occur due to governmental actions, fluctuations in currency exchange rates, and increases in suppliers' prices, among other factors. If the price of Your Travel Arrangements is affected by matters beyond our control, you are required to either pay the additional amount when requested or cancel Your Travel Arrangements following the conditions outlined in these Booking Terms.
All prices are quoted in United States dollars.
Amendments and Cancellations:
We reserve the right to charge USD 100 per change in the event that you wish to transfer to another tour, change a confirmed booking, or alter Your Travel Arrangements in any way. This charge is in addition to any cancellation or other fees imposed by operators, suppliers, or airlines. The charge is applicable irrespective of whether we successfully confirm the amended reservation.
While we will make our best efforts to provide all Travel Arrangements as confirmed, reasonable changes may be made to the Travel Arrangements without notice to You if deemed necessary or advisable by Us at Our discretion.
Cancellation of Your Travel Arrangements by You must be notified to us in writing and will take effect the day we receive it. The following Penalties will apply based on the number of days before Your Travel Arrangements commence:
Between 31 and 60 days – forfeit of deposit
Between 21 and 30 days – 50% of total ground arrangement cost
Between 14 and 20 days – 75% of total ground arrangement cost
14 or Less than 14 days – no refund of total ground arrangement cost
Commercial air flight and airfare cancellation charges will be incurred by you in accordance with Airline Tariff Regulations and will vary based on the type of airfare utilized.
Our cancellation provisions override any conflicting cancellation provisions set out by individual operators or suppliers used by us. No refund is available for cancellations after the commencement of Your Travel Arrangements or for any unused services for any reason.
Cancellation policies may vary for each boutique property, and a 100% non-refundable cancellation fee will be charged accordingly.
